How the OFCCP's Thirst for Data Will Impact You

The OFCCP wants more data. The agency's current proposal for all of this additional data has been described by some as both "burdensome" and "stealthy". McGuire Woods, a 900-person law firm based in Richmond, Virginia, went so far as to say that the OFCCP "does not understand the private sector or have any apparent concern about the burdens and confidentiality issues these proposals place on contractors." In fact, the OFCCP itself estimated it would take 103.2 hours and cost $135,000 to collect and provide all the data that could be requested in the revised Scheduling Letter. read more

OFCCP Releases Proposed Revisions to Disability Regulations

On Friday, December 9, the U.S. Department of Labor's Office of Federal Contract Compliance Programs (OFCCP) released proposed revisions to the affirmative action regulations regarding individuals with disabilities. These proposed revisions represent a foundational change in the formal expectations that OFCCP has regarding the efforts federal contractors and subcontractors make on behalf of individuals with disabilities. OFCCP has shown a significantly increased focus on disability issues in affirmative action compliance reviews conducted during 2011. The proposed revisions represent a further intensification in the agency's focus. read more

OFCCP FAQ Series: Federal Contractor Selection System (FCSS)

Beginning in January 2011, OFCCP implemented its new audit strategy that moved the philosophy of compliance evaluations from management to enforcement. Director Shiu discontinued the previous compliance evaluation strategy of Active Case Management (ACM) and rang in the new year with a new directive, Active Case Enforcement (ACE). The switch to ACE is part of the OFCCP's plan to continually increase efforts to enforce compliance with the laws and regulations it oversees. read more

National Industry Liaison Group - Working Together Towards Equality in the Workplace

The National Industry Liaison Group (NILG) is the premier employer association on affirmative action and equal employment opportunity in the United States. They are a non-profit organization formed for the main purposes of improving communications between the U.S. Department of Labor's Office of Federal Contract Compliance Programs (OFCCP) and Industry Liaison Groups (ILGs); and, enhancing the quality and overall effectiveness of ILGs. The NILG Board supports local ILGs, which are comprised of small, mid-size, and large federal contractors and employers across the country.

The mission of the NILG is to promote Affirmative Action and Equal Employment Opportunity by working closely with the Office of Federal Contract Compliance Programs, Equal Employment Opportunity Commission, related administrative agencies, and local and regional ILGs to:

  • Advocate the positions and viewpoints of constituents
  • Comment and provide feedback on regulatory and legislative initiatives
  • Educate constituents on developments regarding equal employment opportunity and affirmative action and related regulatory changes
